Terms and Conditions

1. General

 

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Brillare Science Pvt. Ltd., hereinafter referred to as “Brillare”, “Brillare Direct App”, ”us ” or ”we”, at the Brillare mobile application.

 

By using Brillare Direct App or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

 

Only persons who can enter into legally binding contract under the Indian Contract Act, 1872 can use Brillare Direct App and/or transact on Brillare Direct App

 

The inclusion of any products or services on Brillare Direct App at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

 

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on Brillare Direct App at the time you place your order.

 

Brillare Direct App wants to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the Brillare Direct App, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions. 

 

SPECIAL OFFER TERMS & CONDITIONS

 

 

1. Prices and Delivery Charges

 

The prices displayed at Brillare Direct App include Goods and Services Tax (GST) or any other alternate indirect tax, but do not include a delivery charge. If the GST rate applicable on the date of the order is changed after the order has been made, the change will be reflected in the price of items without you being notified.

 

The delivery charge for each order will be the same, regardless of the size or weight of your order. The cost for each delivery method is clearly indicated during the check-out process. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.

 

3. Ordering/Conclusion of Contract

 

The ordering option available to you are via Brillare Direct App. Please contact us for further information. 

 

Once you have placed your order, if you have supplied us with your Contact number, you will receive SMS confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. For COD payments, the refund will be done in the form of Wallet Balance. If, for any reason, alternative arrangements are necessary, we will notify you and ask you to contact Customer Service who will settle the refund.

 

2. Payment

 

You can pay for your goods in various ways as set out below.

 

Credit Card or Debit Card

You can enter your payment details at the time you place your order using a valid credit or debit card (VISA or Mastercard). The applicable amount will be debited when you have placed your order in the checkout. Brillare reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

 

Cash on Delivery

You may choose to pay by cash on delivery upon receipt of the goods, without any additional charges.

 

Mobile Wallet

You may choose to pay by Paytm, the applicable amount will be debited when you have placed your order in the checkout.

 

T&C 

·           Interest @18% will be charged if the invoice amount is not paid on or before the due date.

·           Goods once sold will not be accepted back. It will be accepted only if there are any manufacturing defect or breakage during transit. (Please refer Return/ Exchange/ Refund policy for more information)

·           Rs 500/- will be charged on dishonored/ return cheque.

·           We hereby confirm that the invoice shows the actual price of goods described & that all particulars are true & correct.

·           Subject to Ahmedabad Jurisdiction.

 

 

3. Delivery

 

Brillare Direct App exercises the utmost diligence in accepting and processing orders and will endeavor to deliver your order to an address in India, in accordance with your selected delivery option.

Brillare Direct App endeavors to dispatch orders in the fastest possible time and in the order in which they are placed. We aim to deliver within 4 working days following confirmation of an order, unless otherwise agreed. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 10 days, you may cancel your order.

4. Return/ Exchange/ Refund

 

By using Brillare Direct App or Placing Order with Brillare Direct App, you agree to be bound by the terms & conditions set out herein. Please make sure you have read & understood the Terms before placing your order. 

We are committed to providing quality products to our customers. While we hope that you are always satisfied with our Products. For Real purchase, we realize there are times that you may need to return a product. If you will need to return your product, please review the information below.

HOW TO RETURN OR EXCHANGE

·           Select Order Details

·           Select Raise Query

·           Fill in the Required Details with your reason to exchange or Return

·           After Submission the CRM team will get in touch

 

RETURN AND REFUND POLICY

 

·           Returns must be made within 15 days of your receipt date for a refund.

·           Merchandise must be in its original, unopened, and unused condition.

·           Any product that has been purchased on offer or as freebies fall under "No Return/Exchange" unless there is an inherent damage/quality issue at the time of delivery due to a miss from our quality team.

·           We regret that we do not refund original shipping costs with the return. You will be responsible for the return shipping & handling charges, which will not be refunded, unless you received damaged merchandise. 

·           Please make sure to record your tracking number because we cannot issue a refund until our office confirms receipt of the returned merchandise. We are not responsible for lost packages.

·           Returns will be processed within 1-2 weeks of our office receiving your item.

·           All Prepaid orders will be credited to the original credit card used at the time of purchase. Please allow at least 2 billing cycles for the credit adjustment to appear on your credit card statement. For COD orders the return will be credited to the Wallet Balance.

·           Only items purchased on Brillare Direct may be accepted for a return. Items purchased from Brillare Direct cannot be returned or exchanged at distributors that sell Brillare products. Similarly, product purchased from Distributor cannot be returned or exchanged at Brillare Direct

5 EXCHANGE POLICY

 

·           We are happy to exchange any merchandise that is defective or damaged. If you need to exchange your products, please review the information below. 

·           We accept exchanges on items purchased on Brillare Direct only up to 15 days after the delivery of purchase. 

·           Please follow the steps mentioned in ‘HOW TO RETURN OR EXCHANGE’ to initiate the process 

·           If there is a difference in cost with the exchange, one of our customer service representatives may reach out to you for further information. 

·           You will be responsible for the non-refundable return shipping & handling charges if the exchange item is not damaged.

·           You will be responsible for the return shipping & handling charges, which will not be refunded, unless you received damaged merchandise. 

·           Please make sure to record your tracking number because we cannot issue a refund until our office confirms receipt of the returned merchandise. We are not responsible for lost packages.

6 RULES AND REGULATIONS FOR BRANDING

 

·           Branding, Hardware and POP materials will be provided to salons as per company standards only

·           Brillare owns the final approval authority for any branding requisition

·           On receiving the branding request via Brillare Direct, Marketing team will get in touch with you with proposed branding support for your salon 

·           Proposed branding solutions will be based on the Business done by a particular salon in last 6 months

·           Product branding options will be provided on the basis of business agreement with the Salon. For more information, refer Business Benefit Classification.

*For exceptional cases, Brand Manager will review the proposal and process it further which will be provided after approval from management.

·           Branding design requested should be as per the products/brand/therapy available in the salon of Brillare.

·           Branding location should be finalized at the best visible location in salon.

·           Branding designs to salons will be provided only from the artworks finalized by the company 

·           Display Hardware & Customized branding will be provided to salons from the options available with the company and as per eligibility criteria in business benefit classification 

·           The salon has to sign an agreement in case of they are eligible for a hardware, post which the company will initiate the processing of Hardware dispatch

·           All the hardware provided by company (Display units and trolly) are company property & company has the right to take it back if salon stop business with company

·           Brillare has tied up with various vendors/agencies in the respective region/territory and so brandings (execution) at the salon would be done by the appointed vendor/agency. 

·           Timeline for any branding placement at salons ideally will be 10-20 days after the approval. This may vary depending upon the complexity of branding and location. The salon needs to take care of all of the branding property of the company

7 DAMAGED PRODUCTS POLICY

 

·           If you receive an item that is broken or damaged, you may contact customer service within 24 hours for a replacement. 

·           Items will not be replaced after 15 days. We will respond with the appropriate return and/or exchange instructions.

8 TRANSFER OF DATA

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside India and choose to provide information to us, please note that we transfer the data, including Personal Data, to India and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Nothing in these Terms shall exclude or limit Brillare Direct App's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

 

Brillare accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach. 

 

Brillare is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

 

Our maximum liability to you for any loss or damage arising in connection with your order on Brillare Direct App shall be limited to the total price of your order.

 

11. Guarantee

 

If there are defects in the goods you have purchased, Brillare abides by all statutory guarantee regulations. If you have a complaint regarding obvious product or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the Raise Query option in My Order Tab.

 

12. Assignment

 

Brillare reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods. 

 

13. Severance

 

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

 

14. Ownership of rights 

 

All intellectual property rights, such as trademarks and copyrights at Brillare Direct remain with Brillare Science Pvt Ltd. Any use of Brillare Direct or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Brillare.
